To Maj. L. C. Turner, Judge Advocate

As to Leven S. Nicholls aged 21 years of Dickson Co. Tenn reported as captured at Lairsville Tenn June 18, 1863 by W. States forces and brought to Camp Chase Aug 10 1863 charged with having been in the rebel service as a private in Co (I) 16 Reg Ky Inf. I have the honor to report that the charge is incorrect. The prisoner states that he was a private in Co (E) 10 Reg Tenn Cav and was not captured at Lairsville (of which place he has no knowledge) but at home - that he enlisted in said regt Sept 23, 1862 for 12 months and served about 10 months when he deserted at Cowans Station went through the mountains and reached home and there was captured by Col. Bruces forces 28 Ky Cav. He avows his loyalty to the Govt of W States and opposition to secession which he has frequently demonstrated by a refusal to go upon exchange. He avows that he enlisted to avoid conscription and its consequences. I recommend his release upon taking the oath of allegiance to Govt of W States.
Respectfully, /s/ Jasn Gallway, Spec. Comm."
