6/22 S O #12 Army of the South West
Capt W C Adams is authorized to raise one or more Co’s of mounted Infy in Lawrence & Randolph Co’s for C.S.A. & to immediately aback enemy without waiting on special orders

7/12 Smithville-Baber enlisted in & was elected Capt of Co D

7/19 Hindman to Capt C W Adams-directs that you report at once to Gen McBride, cdg N. W. Ark., at Batesville

7/23 Newton to Capt Adams-Gen Hindman directs that you assume command over the Co’s now raised & organized, & armed, in the counties of Greene, Randolph, Lawrence & Poinsett, & move them as rapidly as possible, to some suitable place of rendezvous at or near Jacksonport.
When they are assembled there you will effect a temporary organization of them into a Bn or Regt according to the number of Co’s, the number of them in each Co, who are armed & the kind of arms they have, as that ammunition may be furnished them.
The Bn or Regt thus formed is expected to be used against the enemy vigorously on Crowley’s Ridge as soon as it can be furnished with ammunition, & it is desired that you should rendezvous them & report as early as it possibly can be done. To furnish the ammunition it is necessary to know the number of eff men who are armed, the kind of arms & the number.

Co org dates range from 2/10 for 1 Co & 3 Co’s 2/15 & 1 Co 3/17

7/25 Hindman to McBride cdg North Ark-dismount all your command except the extra Bn as suggested & send their horses home

8/2 Hindman to McBride-It was never intended that Col Adams command or any other Bn or Regt be “independent’. Your attn is called to the order of today dismounting it & ordering it to report to you

II. Capt W. C. Adams is hereby appointed Lt Col, & Capt Milton D. Baker, Major of the Bn composed of the Co’s of

Capt John R. Wells
III. Lt Col Adams will at once assign to duty fit persons for AQM & ACS, with approval of Brig Gen McBride. Such persons appointed to immediately execute their bonds & send same to the proper Heads of Dept’s. Such appointments to be approved at these Hqs
IV. Lt Col Adams will immediately dismount his command & march to the encampment of Gen McBride at Batesville under whose orders he is placed. Col Adams command will be increased to a Regt as rapidly as possible.

When the Regt was finally assembled in Sept, 1862, it contained men from Yell, Izard, Lawrence, & Craighead counties. Its cdrs were Col Robert G. Shaver, Lt Col’s William C. Adams & Milton D. Baber, & Major R. R. Henry. The 38th was formally organized at Jacksonport, Ark on Sept 8, 1862. Shaver was unanimously elected Col
