That is Correct they didn't have the oppertunity to "Vote" on their Commanding Officer. That was because the State of Arkansas had been abandoned by Gen Van Dorn and the Government in Little Rock appointed Col Hiram Grinstead to raise and organize a regiment (33rd Arkansas) from the several independant companies trying to organize at Canden. The Same time (of Sort) was happening with Shaler trying to piece together at first mearly a battalion of Missouri and Arkansas cavalry companies along the borders of Missouri to try and slow up Curtis' army around Batesville and Jonesboro.

The same thing was going on all throught Arkansas under Gen Hindman simply assigning serior officer to raise whatever units they could to throw something in front of Curtis veteran army and keep it from march straight to Little Rock in May of 1862. Formality when out the window in despreate times.
