Capt. J.R. Caps - 40TH Ala. Inf.?

I find listed a Captain J.R. Caps in the Compiled Service Records that is listed as being in Company B 40TH Alabama Infantry Regt. that was paroled at U.S. Army XVI Headquarters at Montgomery, Alabama on 22 June 1865. I am VERY suspicious of the accuracy of this as this is the only record of this man ever in this regiment. His name is not mentioned at all in two diaries that I have read of men of Comany B and furthermore, the 40TH officially ceased to exist when it was consolidated into the 19TH on 09 April 1865. It is certainly possible that this man may have been on leave for some reason and did not know of the consolidation and his subsequent reassignment, but there is no evidence of his ever being there. Also, according to my Broadfoot Roster CD, he is not listed in the National Archives as having a record with any other unit. Any ideas out there? Could this man for some unknown reason reported to XVI Headquarters and requested an officer's parole under false pretenses after the war was well over? Maybe he was a legitamate officer of another regiment whose records were lost and the Yankee clerk at Montgomery wrote down the wrong regiment on his parole?
