I show J.R. Caps as a Private in the 40th, Co. B. Could his last name confused the person paroling him regarding his rank?

Here is what I have on the final Capt. of Co. B:

SPROTT, Samuel Henry, Capt. (Captain after reorganization in April 1865, until surrender on May 4. Originally in Company A, and was from Sumter Co. Born 6/24/1840.)

Of course, as you say, Caps *might* have been Capt. at one time, and been away from the regiment...say at a hospital.
