The Creoles were rejected on this occasion for service in the regular Confederate army but it appears they did see some duty as Confederate militia in March of 1862.
Review these documents and tell me what y'all think.

I. The Creole Guards having organized as a Volunteer Military Company, and elected the following officers, said Company is accepted as a Volunteer Company in pursuance of Special Order No. 13, and will constitute Company A of the Creole Volunteers:

II. Capt. Barnard will report directly to these Headquarters.

9th Brigade Alabama Militia transferred to Confederate command, March 12, 1862-

Executive Department, Headquarters, Mobile, Ala., March 12, 1862.

Special Order No. 7

I. In pursuance of the extraordinary powers conferred upon the Executive of the State in the present emergency, I have deemed it necessary to order your Brigade into the field of active service for a period of ninety (90) days, unless sooner discharged.

II. As the necessity imposed upon the people of the city and county of Mobile to go into active service may occasion individual disappointment and interfere with private enterprises necessary to the public advantage--to avert these difficulties and obtain the active services of all efficient troops within the limits of your command in the shortest practicable time, you are hereby directed to order into service such troops, companies, battalions and regiments, or such portions of them as you may deem best for the public safety.

III. You are authorized to increase the number of rank and file in companies to one hundred and twenty-five, and the number of companies in the second and third regiments of Alabama Volunteer Militia now in the service to ten each, and for that purpose may order out and attach thereto such other companies or such forces arriving from the interior as may prefer to be connected with the second and third regiments of Alabama Volunteer Militia respectively, until they shall be increased to the number of ten each, and to the maximum of a company as above authorized.

IV. You will order out the 48th, 89th, 94th and 95th Regiments respectively in such portions of companies, battalions or regiments, and at such times as you may consider most conducive to the public welfare, and to meet the necessities of the impending danger.

V. You are, with your staff, hereby ordered into the service of the State, and will assume the command of the second and third Regiments of Alabama Vol'r Militia, and of all such additional forces as may be organized in pursuance of this order. You will report to Brig. Gen. Jones, commanding this Department, and will make your requisition for quarters, transportation and subsistence of the troops under your command, upon the proper officers of the Confederate States.

VI. Should you not deem it expedient at this time to put into service your entire command, you will order such portions, as are not placed in active service, out for drill, discipline and review as often as you may consider it necessary and proper.

The reader will find in our advertising columns a very interesting and important "Special Order" from Governor Shorter to Brig. Gen. Butler. It will be seen that the two volunteer regiments now organized here may be increased to ten companies each, and each company to one hundred and twenty-five members. The Brig. General and staff, and the entire militia of the brigade, are ordered into active service for ninety days, to be paid, provisioned, etc., as Confederate troops. The order, however, very properly gives the Commanding General a wise discretion as to the portions of his command which shall be ordered out for full time.
