Tensions flared following Shiloh. His authority weakened, Merrick resigned his command on May 14 and several officers left with him. This departure led to the appointment of Captain Allen R. Witt of the "Quitman Rifles" to the position of Colonel of the regiment.17 The 37-year old farmer could not immediately take effective command as he was recovering from a wound received at Shiloh.

After the Battle of Shiloh the regiment went back to Corinth, where they reorganized. Formal charges related to the disorganized condition of his regiment were brought against Colonel Merrick. He resigned and on May 27, 1862 Captain A. R. Witt of Company A, The Quitman Rifles, was promoted to colonel and became commander of the regiment.
