I believe this John was most likely his brother:

John J. Mays, Private, Company E, 51st Regiment Virginia Infantry, enlisted July 1, 1861 at Nelson Court House for the war, last recorded present at the October 31, 1863 muster,* receipted for an issue of clothing March 10, 1864, died at New Market, no date

* Note, this is the last Company E muster roll in the records
