Scott resigned his command and rank on October 8, 1863 and returned to Louisiana. Lt. General L. Polk requested that he be recommissioned and that the 1st Louisiana Cavalry Regiment be removed from the Army of Tennessee and assigned to him. The request was endorsed by President Davis and S. Cooper. The 1st La. Cavalry Regiment would be exchanged for Gantt's Tennessee Regiment. This happened in Jan, 0f 64. At that time they were unattached under the command of Captain E. Green Davis. Only having 13 Officers and 140 Troopers. Polk reassigning the 1st La. Cavalry to the District of S. Mississippi and E. Louisiana. All the commands in the area were organized under Scott into a brigade. He commanded this brigade until his arrest on February 10, 1865, reported at his home out from Bayou Sara, under arrest for furloughing without authority. Reported that he furloughed his command and they were to reassemble in Summit, Mississippi. After his arrest, command went to Major S. W. Campbell.
