Unfortunately this case is not so clear cut, as both the 75th and 107th Ohio were there on Cemetery Hill during Hays' attack the evening of 2 July, in fact quite close to one another, the 25th Ohio with about 70 men being between them in a single loose line. The 107th and 25th faced northwest; the 75th northeast. From right to left, Hays' Louisiana brigade was composed of the 5th-6th-9th-7th-8th regiments. I recently looked closely at the primary sources and concluded that the right regiment (5th Louisiana) of Hay's brigade broke through between the 25th and 107th. The 25th scattered, some going south as prisoners, while the bulk of the 107th fell back. The 9th Louisiana went over and through the 75th Ohio, which held in some places. The 8th swung around and went up the hill past the 17th Connecticut, and entered Battery I, 1st New York and Battery F/G, 1st Pennsylvania, but men from the other Louisiana regiments were represented as well on the crest, all mixed together. From the above movements alone, one can understand how the 75th Ohio could have lost their colors. Just how the 25th Ohio could have held onto their colors while being so completely overrun is hard to conceive. But the center and left (abutting the Baltimore Pike) of the 107th Ohio regiment were not directly confronted by the Tigers' initial assault, and so should have been able to hold onto their colors as they fell back. A breakthrough by a portion of Hoke's NC brigade was also made further down the line, driving back the left of the 41st New York. Incidentally, a little off topic, but just prior to this action a cannon came hurtling down the hill into the ranks of the 41st, perhaps from Battery L, 1st New York. I would surmise this incident occurred from the recoil of the gun when it was turned to fire on Hays' brigade; it may have rolled clear of the lunette before the gun crew could stop it. However, no battery record that I can find assumes responsibility for this embarassing incident. I would suppose the gun remained there until after the Confederate repulse, but have looked in vain for any Confederate claim from Hoke's brigade of having captured a cannon at the base of the hill.
