When I consider the fact that the 9th Alabama was not directly engaged in close combat Antietam, I doubt they would have lost their colors. A large part of the 9th was involved in the siege at Harper's Ferry and were just arriving at Antietam that morning, well after the battle started. In the afternoon, they were brought up to the Peach Orchard, in support of the retreating Confederates, as the Sunken Road position fell. While in that support, they took significant casualties, from infantry and artillery, who were advancing from that location, but they were not engaged in close combat. They were clearly not overrun. I have not seen any indication in my records of the 9th that they lost their colors during this campaign.
