This man's records are filed under Henry Avey, Co. A. 13th Battalion, Partisan Rangers. His name appears to be written as Avey, Arey, and Arry. There is only one muster roll card in his file. It is for the period Sept. 6 - Oct 31, 1862, and states that he enlisted Sept. 6, 1862, at Jasper for three years or the war. It also states that he has been absent without leave since Oct. 22, 1862. All the rest of his file (nine pages) is a hand-written record of his court martial at Columbus, Mississippi, March 20, 1863. It is a fairly complete document of the proceedings including the testimony of witnesses. He is charged with desertion, and there is testimony that he was arrested, escaped, and was arrested a second time and held for a time in the Walker County jail. In the final judgement of the court, he was found not guilty of desertion, but guilty of being absent without leave. The court concluded that, "Owing to the protracted confinement of the Prisoner The Court is of the opinion that he has Already been sufficiently punished and do therefore acquit him."
There is no further information on him in his file.
