The only Patton that I have listed as being a member of the 40TH Ala. is J.E.Patton. This name is also found spelled Patten, but on all documents that I have copies of that bear his signature, the name is clearly spelled Patton. J.E. Patton enlisted in Company K, 40TH Alabama Infantry Regiment at Mobile, Alabama on 10 May 1862. This is at the organization of the regiment. He was sworn into service by Major Forney. He was elected to the position of Junior 2ND Lieutenant on 16 May 1862. He was promoted to 2ND Lt. on 15 July 1862. He is recorded as having died on 10 June 1863. There is no mention as to what was the cause or location of his death. No mention of where he was buried. During this time the regiment was under siege at Vicksburg, Mississippi and he most probably died there either from wounding or disease, however he could have been elsewhere in a hospital or on a sick furlough. I wish I could offer more information, but this is all that I currently have. All this is from his Compiled Service Record from the National Archives.
