Looking for last name, Martin or Cumby, and could have been told they would hang him, maybe I got it wrong, since it was a long time ago I heard the full story. But do know that my grandmother Born 1902, passed 1985, had a newspaper article about him being captured,(I do not have it) plus she said he was shot in the arm by an Indian once he was forced to join the other side. Said he was buried at the same location as JEB Stuart, plus she gave me the book about JEB Stuart "The Last Cavalier". I know she gave my father the article, but when he passed away in Feb. of this year, I could not find it. My Grand mother was born a Cumby and her mother was a Martin, her father was Joel Thomas Cumby, this family according to the 1910 census, were in the Appomattox, Lynchburg area, plus she belonged to the daughters of the confederacy, if that helps.
