I think both may be him. I have looked him up before and it says he was "mustered into Co. I. late in 1864 and recieved his parole on 4/9/65." That must be just his parcial record because I have another source that says "Even though he was in the midst of every conflict with the Army of Northern Virgnia, he survived the war and received his parole at Appomatox."
