Before consolidation, Waul’s Legion was composed of two infantry battalions; Lt Col Timmons commanded the 1st Battalion

The two Infy Bns were consolidated by S O #88; Hqs, District of Tex, New Mexico & Arizona dated March 23, 1864, & formed Timmons’ Regt Tex Infy."

3/23/64 Waul’s Legion having materially decimated by disease, transfers & the fortunes of war, it is hereby ordered the 2 Bns be consolidated as follows;
Col Timmons
Lt Col Wrigley
Maj Bolling
The dtchmt of Co B 1st Bn will be consolidated with Co B 1st Bn
The dtchmt of Arty now on duty with Mahan’s Btry will be regularly transferred thereto
Surplus officers will report to these Hqs for assignment to duty
Any Cav dtchmts of the Legion will be assigned to Col Duff

March 64-Lt Col Wrigley on dtchd service collecting deserters
