Isn't it Ironic that the first line of this Oath says that the subject is to swear to defend the Constitution. And the second line tells the subject he has to accept the UNconstitutional acts of Congress regarding slaves, and the Unconstitutional Proclaimations made by the President and Supreme Court.

This oath did not apply to the slave owners in Northern states. The part of Article 4 of the Constitution which allowed slavery in the United States was not repealed until after the War was over. So without that repeal the acts of Congress, the President, and the Supreme Court were null and void.

The Act that ratified the 13th Amendment, and did repeal that portion of Article 4, is somewhat questionable since 11 of the States that ratified that amendment were not repersentative of a free people, since they were under occupation governments under which a sizeable portion of their populations were not eligiblle to vote. The vote to ratify the 13th Amendment was not unanimous among the Northern States.

If the occupied Southern States had been allowed an unfettered vote, would the 13th Amendment been ratified?
