The problem with aany Federal Court or Supreme Court Ruling over the history of this country is consistancy. The guideline for any of those decisions was supposted to be the Constitution and only the Constitution. But with no accountability for thier decisons we have allowed foriegn law and political opinion and even morality to subvert the legal interpretation of our primary documents to fit the desires of the political moments in our past. Now we have an inconsistant set of laws to the point that everything has to be decided by the Supreme Court to see what they think because they no longer rule according to the Constitution either.
