2Lt. Emmet Weaver Co. D 9th MS Inf Surrender Roll

I thought I had all of the men who surrendered in Company D of the new 9th Regiment at Greensboro, NC nailed down, but now I have another question. I am confused about another of the officers, 2nd Lt Emmet Weaver. The May 1, 1865 surrender roll shows the date he was appointed 2nd LT as 4/8/1865. There is a second record with the 9th MS records showing that 2nd Lt Weaver signed an Oath of Allegiance, apparently on June 9, 1865 in Nashville, TN. The Oath of Allegiance record gives his residence as Desoto Co., MS and described him as having a fair complexion, light hair, hazel eyes and being 5' 8" tall. I cannot find a match for this man in any of the regiments that were consolidated to make up the new 9th Regiment at the end of the war. Does anyone out there have any information on this man? Is he another staff officer who was put back into a line unit at the end of the war?
