According to Confederate inspection reports, free blacks were conscripted for non-military tasks during 1864. Some time back I found a report for the State of Virginia which gave numbers conscripted by quarter, numbers assigned to department, such as quartermaster, commissary, medical &c. I have to assume such conscription was based on law.
