This order comes from the Kansas State Militia, which, like the Missouri Enrolled Militia, was pretty well organized during the war. The order only pertains to units of that militia and not the US Army itself. I have not heard of the US Army ever appointing the rank of ensign for their color sergeants during the war. Now we know that at least one militia force did so.
