The original Confederate Conscription Act was revised and eventually repealed and replaced. The Confederate Conscription Act revision of Sept. 1862, and the act of Feb. 1864 raised the ages to 45 and 50 respectively.

In both cases he would have been eligible. The 1862 revision did not take effect until July 1863 but that would put him right on the upper bound. (And even if he was one year over, one wonders if conscription agents would always accept claims of birthdate if one was not originally from the area and did not appear considerably older than the cut off.)
