No soldier took this flag. The 5th overtook the Union breastworks, and along with O'Neil's 26th Ala. Inf., planted their flag on the breastworks. The regiments were pushed out of the breastworks by the Union counterattack. When the Confederates pushed into the breastworks again, the 5th's flag was retreived from the breastworks, as was the 26th's. So, as you can see, it was simply left standing on the breastworks through the day's fighting. As an aside, the 26th's flag was retrieved by the 4th Va. Inf.
