Pick up a copy of Bloody Banners and Barefoot Boys: A HIstory of the 27th Regiment Alabama Infantry, CSA, Noel Crowson and John V. Brogden, eds. The narrative by J. P. Cannon on p. 2 and Capt. Isaac B. Rogers of Co. "B" on p. 126 describe the period you mentioned. Cannon mentions that officers and men were sworn in by General S. D. Weakly of Florence. Weakly would have been a militia officer, and I expect Foster's Regiment was situated on a militia camp ground not far from the river at Florence.

Company "D" organized on December 5, 1861, the earliest to form of the ten companies in this regiment. I'd expect recruiting activity several weeks earlier, but probably nothing before late October or early November of 1861.

You may be thinking about Smith's 3rd Alabama Battalion, which organized with five companies at Tuscumbia on Oct. 5, 1861. Three other companies were in camp, but, refusing to enlist for three years like the others, disbanded and went home. This command eventually became the 26th Alabama Infantry.
