I will check again, but I don't believe that the 40th carried flags other than the two in the Archives. The ebay flag by all appearances was a reunion flag, likely copied in the 19th or very, very early 20th century from the Department of Alabama, Mississippi and E. Louisiana flag which was issued to the regiment (actually to each regiment in Moore's brigade), which was, indeed, in private hands, therefore available for an old comrade to use to make a copy.

Also, it is likely the original flag was sneaked out, as was the flag of the 42nd, mentioned as having changed hands recently. That flag was on loan to the ADAH for several years, was conserved, and is fully documented. A shame it fell into the collectors market.

As for other flags, the unmarked Hardee Pattern flag of the 19th/33rd Ala. consolidated is in private hands in Texas. A second national pattern flag of the 32nd Ala. was, last I knew, in Texas also.

There is a flag of the 31st and on of the 45, I belive, in the Iowa statehouse.

There are a couple of Alabama flags, including the 2nd Battn. Hilliard's Legion flag from Snodgrass Hill in Confederate Memorial Hall in New Orleans.

The 37th's Departmental colors, matching the 40th's Gulley flag is in the library at Auburn.

The Lumsden's Battery flag is in special collections at UAT.

There is a potential flag of the 1st Alabama Cav. at Confederate Memorial Park in Mountain Creek.

Stay tuned for news on a pair of ANV second wool bunting flags, one of the 10th Alabama, one of the 44th, that will soon come out of hiding.
