Bryan, I have the Compiled Service Records from The National Archives for the 40TH Alabama Infantry Regt. and I do show a Private James Payne of Company K, 40TH Ala. He is shown as enlisted by Lt. Cobbs on 13 March 1865 at Sumter County, Alabama and as present and due his enlistment bounty on muster roll for March and April of 1863. Unfortunantly there are no other records available for him with this regiment. I do not know what became of him, but I do know that he was not present to be paroled at Vicksburg with the rest of the Company in July 1863 and was not found on the roster of the 19TH Alabama at the final surrender in 1865 (the 40TH was consolidated into the 19TH shortly before the final surrender and therefore men whom had been with the 40TH were paroled as members of the 19TH). He may for some reason or another have transfered to another unit after joining the 40TH. Most records of the 40TH are missing from the summer of 1863. I have found the following men listed with the National Archives that may also be this man if he transferred to another unit. This is just a possiable guess on my part. I have no evidence of this being the case.

If you have any additional information whatsoever, please share it with me as I am slowly ,but surely compiling a history of the 40TH.
